Personal Data
We process data that you have provided to us or that we have lawfully received or collected from third parties on the basis of a legal basis (Union law or national legislation) or your consent. “Personal data” refers to any information relating to an identified or identifiable individual. Special categories of personal data (“sensitive” data) are subject to a higher level of protection.
The articles published on this website are protected by copyright. All rights reserved. Reproduction is permitted for non-commercial purposes, provided the source is cited and the content remains unchanged. Commercial use of texts from this website is permitted only with the written consent of the Ministry of Social Affairs.
Legal Basis for the Processing and Storage of Your Data
The legal basis for the processing of your data is found in Article 6(1) of the General Data Protection Regulation (GDPR), depending on whether
- You have consented to the processing of your data (Art. 6(1)(a) GDPR or Art. 9(2)(a) GDPR; e.g., when subscribing to the newsletter),
- the processing is necessary for the performance of a contract or for the fulfillment of precontractual obligations (Art. 6(1)(b) of the GDPR; e.g., when entering into a contract for services),
- processing is necessary to comply with a legal obligation (Art. 6(1)(c) of the GDPR)
- or the processing is necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in us (Art. 6(1)(e) of the GDPR).
You may revoke any consent you have given at any time.
Special categories of personal data (“sensitive” data) and data regarding criminal convictions are processed only in accordance with the provisions set forth in Article 9(f) of the GDPR.
In accordance with Article 6(3) and (4) of the GDPR, national data protection laws may set forth more specific provisions regarding processing carried out pursuant to Article 6(1)(c) and (e) in order to define the requirements for such processing and other measures more precisely.
Your data will be stored only as long as necessary to fulfill the intended purpose. After that, provided there are no legal retention, documentation, or statute of limitations requirements to be observed, it will be deleted or, at the very least, any link to you will be removed (anonymization).
The provision of data may be required by law or by contract (for example, to fulfill a contract, certain data—such as names, addresses, etc.—must generally be provided; otherwise, the contract cannot be concluded).
Who receives your data (recipients)?
Within the Ministry, your data will be shared with those departments or employees who need it to fulfill contractual, legal, and other obligations. Furthermore, your data will be shared with the data processors we have engaged, who are obligated to treat the data confidentially and to process it only to the extent necessary to provide the contractually agreed-upon services. Statutory provisions may require the transfer of data to other public authorities.
As a general rule, your data will only be shared if you have consented to its transfer or if such transfer is required by law.
What are your rights?
You are entitled to the rights set forth in the GDPR and the DSG; this means that, in principle, you have the right of access, the right to erasure, the right to rectification, the right to restriction of processing, the right to object, and the right to data portability. You may withdraw any consent you have given at any time.
Certain rights may be restricted in accordance with Article 23 of the GDPR. In some cases, legal provisions—such as retention periods, documentation requirements, or statutes of limitations—may prevent data subjects from exercising their rights (for example, a statutory retention period could take precedence over the right to erasure).
Pursuant to Section 24 of the Data Protection Act (DSG), you have the right to file a complaint with the Austrian Data Protection Authority (dsb@dsb.gv.at; Barichgasse 40-42, 1030 Vienna) if you believe that the processing of your personal data violates data protection law.

Emails we receive are processed by the appropriate organizational unit in accordance with legal requirements, depending on their content and the nature of the request made therein.
